CHARLIE SHEEN’s wife BROOKE MUELLER wants a U.S. judge to change the terms of a protective order she has against the actor to allow the couple a chance to reconcile and save their troubled marriage.

The Two and a Half Men star was arrested on Christmas morning (25Dec09) after a nasty dispute with Mueller in Aspen, Colorado.

Sheen faces charges for second-degree assault, menacing and criminal mischief for the incident, in which he is alleged to have threatened his wife with a knife, and he is due in court in February (10).

But, contrary to tabloid rumours, Mueller is refusing to give up on her marriage and wants to settle her differences with Sheen, reports TMZ.com.

She has hired top criminal defence lawyer Yale Galanter to represent her and he is planning to file papers in an Aspen court on Wednesday (30Dec09) to request permission for the pair to resume contact “so they can work on resolving the conflicts in their marriage”.

Galanter has also played down the events of Christmas Day, branding it “one bad night” in their 19-month marriage.

Sheen has since returned to Los Angeles while Mueller has stayed on in Aspen.

He faces up to eight years for the menacing charge, the most serious of the three, in addition to a fine of between $2,000 (?1,250) and $500,000 (?312,500).

Galanter’s comments echo those of Sheen’s manager Mark Burg, who claimed the couple is set to undergo counselling together in the New Year (10) and have no plans to divorce.
